Terms of Service
These Terms are entered into between you and SquareKick LLC, a TX limited liability company. By accessing or using https://squarekick.org or the SquareKick mobile application, you agree to these Terms of Service.
1. Overview
SquareKick is a skill-based NFL and NBA matchup sports squares platform where users participate in live matchup-based contest rooms tied to real-world sporting events.
The platform is designed around participant judgment, sports knowledge, statistical analysis, matchup evaluation, and square-selection decisions. In Skill Card rooms, SquareKick uses a skill-predominant scoring model where Skill Card performance is the primary determinant and square/digit position is a limited secondary scoring component under the locked room weights. It does not operate as a sportsbook, house-banked casino, slot machine, lottery, or house-banked product.
No representation is made that the platform, any contest, any contest room, any paid entry, any wallet feature, or any payout feature is lawful in every jurisdiction. Availability of skill-based contest language does not override federal, state, local, payment-service, or app store requirements.
SquareKick does not guarantee winner awards. Participation is subject to the posted rules, room setup, Skill Card scoring rules when available, room cutoff/shuffle timing, platform controls, eligibility restrictions, and applicable law in effect at the time of entry.
Paid room entry may use physical-location verification before payment confirmation. The platform may use secure location-verification signals, user declaration, or a trusted location-verification service when configured.
2. Eligibility
- You must be at least 18 years old
- You must provide truthful registration information and keep your account details current
- You must comply with all applicable laws in your jurisdiction and are responsible for determining whether your use of the platform is permitted where you are located
- Certain contests, contest rooms, square selections, payout features, promotional contests, fantasy-style contests, sweepstakes-like features, or similar functionality may be restricted or unavailable in certain states, territories, or localities
- You may not enter, fund, or participate in a room if you are located in a restricted jurisdiction or if your participation is prohibited by applicable federal, state, local, territorial, tribal, payment-service, app-store, or platform compliance rules
- SquareKick may request, verify, or use age, account, location, device, IP address, payment, payout, tax, or identity-related information to confirm eligibility and restricted-jurisdiction compliance before allowing entry, payment, withdrawal, payout, award credit, or continued account access
- For paid room entry, eligibility depends on the user being physically located in an allowed state at the time checkout starts. Residency, tax address, billing address, profile state, and payout state do not determine paid-entry eligibility
- If the Current Physical Location State declaration, location-verification decision, or other location-control result does not satisfy the allowed-state rules, SquareKick may block checkout before payment confirmation
3. Account Registration, Security, and Review
- Only one account per user is permitted unless expressly authorized by the platform
- You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account
- Accounts may be suspended, restricted, reviewed, or closed for fraud, abuse, policy violations, payment problems, chargebacks, eligibility concerns, or platform security reasons
- SquareKick may suspend, terminate, restrict, or close accounts, freeze or hold balances, cancel entries, reverse transactions, or withhold payouts while conducting fraud, abuse, chargeback, identity, AML-related, compliance, payment-service, or dispute review
4. Contest Participation and Contest Rules
SquareKick may publish or update Official Contest Rules, State Restricted Jurisdiction Lists, AML/Fraud Policies, Chargeback Policies, identity-verification requirements, or other compliance materials. Those materials are incorporated into these Terms to the extent applicable to your use of the platform.
- Users may enter available rooms by paying the displayed entry amount and following the room rules in effect for that room
- The platform may offer full-square entries, half-square entries, manual square selection, auto-assignment, reservations, and other room-specific participation options
- Reservations and selected squares are temporary until checkout successfully completes and the entry is finalized; Skill Card submissions, scoring rules, tiebreakers, and reserve-square handling are governed by the posted room rules
- Participants are encouraged to use NFL/NBA research, team and player statistics, scoring tendencies, matchup analysis, injury and roster information, pace-of-play considerations, and other sports knowledge when deciding whether and how to participate
- Outcomes are determined by the room rules, Official Contest Rules, published platform results, applicable matchup scoring data, and any state or local eligibility restrictions then in effect
- Participation does not guarantee winner awards; Skill Card scoring rewards submitted predictions and may still result in no prize for an entry
- Skill Card-1 opens after a player joins a Skill Card room and locks at the room cutoff/shuffle time, 30 minutes before kickoff/tipoff. Skill Card-2 opens after shuffle when row and column digits are revealed and locks before kickoff/tipoff, 2 minutes before kickoff/tipoff
- In Skill Card rooms, straight and reverse prize slots are ranked by the room’s locked Combined Score. The commonly used model is normalized Skill Card score times 80% plus square/digit score times 20%, and the locked room configuration controls the applicable values for that room. SquareKick uses a skill-predominant scoring model where Skill Card performance is the primary determinant and square/digit position is a limited secondary scoring component
- If a room uses posted straight/reverse digit rules, the posted room rules explain how straight/reverse score digits are applied for that room
- Rooms may use a 100 Squares Guaranteed payout model or a Collected Funds Only payout model. The room notice and award breakdown identify which model applies before entry
- Under the 100 Squares Guaranteed model, platform reserve entries may cover unfilled squares but are coverage-only entries and are never eligible to win. If an exact two-digit target is platform reserve, eligible one-digit participant fallback positions may share the prize; if no eligible fallback exists, the slot is marked No eligible winner and moves to the No-Winner Return Pool after the room is final
- SquareKick reserves the right to modify, suspend, discontinue, or remove features, contests, rooms, wallets, payout methods, or services at any time, subject to applicable law and these Terms
5. Shuffle, Lock, Room Operation, and Score Corrections
- Board digits are assigned through the platform shuffle process and become binding for that room once the board is finalized
- Rooms, matchups, and live views may change state over time, including upcoming, locked, live, completed, canceled, or similar operational states
- When a filled room locks, the platform may automatically create the next room with registration closed. That room stays closed unless an SquareKick support opens registration. If it is not opened before the configured deadline, 60 minutes before kickoff/tipoff under the configured timing, the unopened follow-on room may be deleted automatically
- The platform may restrict purchases, edits, refunds, or ownership changes after room lock, shuffle, kickoff, or other configured cutoff times
- Official scoring, statistical feeds, and matchup data may be corrected or updated after initial publication by leagues, data services, or the platform
- SquareKick may correct, recalculate, delay, or update results, standings, wallet credits, winner awards, payouts, or related records when official data, scoring corrections, service updates, service issues, or platform errors require adjustment
6. Payments, Wallet, Fees, Payouts, and Taxes
- Users may deposit funds, pay for entries, receive winner awards, and request withdrawals through the platform features that are then available
- Room pricing, award allocations, and related calculations are governed by the active room financial settings
- The 100 Squares Guaranteed model uses the full room guarantee under platform reserve rules, while the Collected Funds Only model calculates winner awards only from paid participant entries collected for that room
- No-Winner Return Pool amounts, if any, are returned after the room is final to funded room contributors based on paid contribution amount, minus any unrecoverable processing, transfer, or payout fees where applicable
- Payment processing, payment authentication, and payout onboarding may be handled through third-party services such as Stripe
- If a duplicate finalization request is received while payment finalization is already running, the platform may wait for or reuse the original finalization result so that a successful payment maps to one confirmed entry set rather than duplicate entries
- Winner awards, withdrawals, payout setup, and transaction records remain subject to platform review, service requirements, fraud checks, AML-related review, identity verification, tax reporting requirements, chargeback review, and operational controls
- SquareKick is configured for U.S. skill-based contest award reporting using Form 1099-MISC only; W-2G withholding logic is not part of the platform tax setup
- SquareKick may request secure taxpayer information through Stripe Connect or another professional tax service, may track gross winner awards by calendar year, may maintain internal 1099-MISC review records, and may issue or support issuance of Form 1099-MISC when legally required
- SquareKick may delay or hold winner payouts, wallet award credits, withdrawals, or related payout activity when required payout or tax-reporting information is missing, incomplete, expired, unverifiable, or otherwise requires review
- Users are responsible for providing accurate payout and tax information, reporting award income on their own tax returns, and paying any federal, state, local, or other taxes owed on winner awards, withdrawals, awards, wallet credits, promotional amounts, or other amounts received through or in connection with SquareKick
- Unclaimed balances, dormant wallet balances, abandoned accounts, or other unresolved funds may be handled in accordance with applicable unclaimed property, escheatment, account-closure, or similar laws
7. Refunds, Cancellations, and Chargebacks
- Entry fees are generally non-refundable once a room or matchup passes the applicable refund or lock cutoff
- Refunds, reversals, or cancellations may occur in limited circumstances, including room cancellation, voided contest participation, payment problems, reservation expiration, unavailable inventory, payment or service issues, fraud review, or other platform-determined operational reasons
- Where a transaction cannot be finalized, the platform may cancel the attempted entry and return the user to an eligible pre-payment or wallet state consistent with the operating logic of the platform
- Required state/location eligibility decisions are designed to occur before Stripe payment confirmation so that failed location checks prevent checkout from completing rather than intentionally charging first and refunding later
- Chargebacks, payment disputes, failed payments, suspected unauthorized transactions, bonus abuse, or suspicious payment activity may result in account review, balance holds, payout delays, transaction reversals, or account termination where permitted by law
8. Notifications and Communications
- By using the platform, you agree that we may send service-related messages about your account, contest participation, results, payouts, withdrawals, compliance review, disputes, and policy updates
- Mobile app users may also receive push or in-app notifications when available on their device or account
9. Prohibited Conduct
Users may not:
Violations may result in account suspension, account termination, balance holds, forfeiture where permitted by law, cancellation of entries, reversal of transactions, payout withholding, service reporting, or other action permitted by law and platform policy.
- Use multiple accounts or false information
- Attempt to manipulate square ownership, payment flow, scoring, results, notifications, withdrawals, or payouts
- Interfere with the platform, reverse engineer abusive workflows, scrape protected content, exploit service issues, or engage in fraudulent, deceptive, collusive, or abusive behavior
- Attempt to bypass state, location, identity, KYC, payment-service, restricted-jurisdiction, or compliance controls
10. Intellectual Property
All platform content, software, code, designs, graphics, interfaces, branding, logos, trademarks, service marks, trade names, text, documentation, technology, and related materials are owned by SquareKick or its licensors and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, reverse engineer, sell, lease, frame, scrape, reproduce, create derivative works from, or commercially exploit any part of the platform except as expressly permitted by SquareKick in writing.
11. Third-Party Services and Platform Availability
The platform may rely on third-party services for payment processing, payout onboarding, identity or payment verification, secure infrastructure, analytics, messaging, mobile app services, score updates, live countdown/score updates, and support features.
SquareKick is not responsible for third-party outages, service restrictions, delayed data, account-link expiration, app store rules, payment-service holds, or other third-party conditions that affect platform availability, payments, withdrawals, or payouts.
12. Limitation of Liability
SquareKick provides the platform on an "as is" and "as available" basis and makes no guarantee of uninterrupted service, continuous availability, lawful availability in every jurisdiction, eligibility for every user, payout timing, or any particular result or winner-award outcome.
SquareKick shall not be liable for outages, delays, errors, cancellations, service interruptions, or unavailable features caused by acts of God, internet failures, cyberattacks, government actions, sporting event cancellations, labor disruptions, service interruptions, payment-service interruptions, data-feed disruptions, app store restrictions, or other events beyond SquareKick’s reasonable control.
To the maximum extent permitted by law, SquareKick is not liable for indirect, incidental, consequential, punitive, exemplary, or special damages arising out of use of the platform, third-party services, payment or payout delays, contest participation, event data delays, score corrections, or interruptions.
13. Compliance and Jurisdiction
SquareKick operates only where permitted and as a lawful skill-based sports contest, fantasy-style entertainment, or matchup-analysis platform, subject to applicable federal, state, and local requirements.
Users are responsible for compliance with local laws, taxes, reporting obligations, eligibility restrictions, and other legal requirements applicable to their participation, wallet activity, winner awards, or withdrawals.
Formation or operation through a TX limited liability company does not by itself determine whether a contest is lawful in any jurisdiction. We may restrict access, contest participation, deposits, entries, withdrawals, payouts, promotions, or transactions where required for legal, operational, payment-service, app store, or risk reasons.
SquareKick may maintain restricted jurisdiction controls or compliance review workflows, and availability of a feature in the user interface does not guarantee that a user is eligible to use that feature in every location.
14. Texas Participation, Privacy, Consumer Protection, and Geofencing Terms
Texas residents and users located in Texas remain subject to all eligibility, age, location, payment, payout, tax, consumer-protection, privacy, contest, prize, and responsible-play requirements that apply to their participation. SquareKick does not represent that every room, contest structure, prize feature, wallet feature, withdrawal feature, promotional feature, or real-money participation feature is available or lawful for every Texas user or in every Texas location.
Skill-contest affirmation and player warranty. SquareKick is a lawful peer-to-peer skill-based sports squares, fantasy-style entertainment, or matchup-analysis contest platform where permitted. Texas users acknowledge that SquareKick is not a sportsbook, casino, slot machine, lottery, banking game, house-banked gambling product, bookmaking service, or unauthorized wagering platform. By registering, funding an entry, or entering a paid room from Texas, the user represents and warrants that the user is participating only where lawful and understands that contest results are determined by human skill metrics, including matchup analysis, sports knowledge, Skill Card predictions, tiebreakers, square-selection strategy, timing decisions, and other posted skill-based rules rather than a prohibited game of chance under Texas Penal Code § 47.01 et seq. or similar laws.
Texas fixed-prize and no-parimutuel participation conditions. Texas law may treat a transaction as a prohibited bet if something of value is won or lost to any degree dependent on chance. Texas participation is offered only on the condition that posted rooms are structured as skill-based contests with objective scoring rules, predetermined and guaranteed award terms, and disclosed entry conditions before entry purchase. SquareKick does not participate as a contestant, does not permit side bets or user-to-user wagers, and does not authorize parimutuel or fluctuating prize structures that vary based on real-time entry collections except as expressly permitted by posted room rules and applicable law.
Texas gambling-law acknowledgment. SquareKick does not authorize any user to use the platform for unlawful gambling, unauthorized online wagering, side bets, bookmaking, pooled betting outside posted room rules, disguised sports betting, illegal internet gambling, or any activity prohibited by Texas law. Users may not treat entries as wagers on sports outcomes or use SquareKick to facilitate third-party betting. Any attempt to use the platform for unauthorized gambling, disguised betting, collusion, account sharing, score manipulation, payment fraud, location spoofing, or other unlawful conduct is a material breach of these Terms and may result in account restriction, cancellation of entries, voiding of awards, forfeiture where permitted by law, and reporting to appropriate parties.
Fee Transparency, Platform Rake, and Prize Payout Math. To avoid ambiguity under the Texas Deceptive Trade Practices-Consumer Protection Act, Tex. Bus. & Com. Code § 17.41 et seq., SquareKick discloses that entry fees are collected for the applicable contest-room entry, that the platform may retain the disclosed service or platform fee shown in the app, room details, rules, or settings-driven room configuration, and that the remaining room pool is distributed according to the room’s locked straight/reverse award percentages, Skill Card settings when available, square/digit scoring rules, tiebreakers, payout eligibility requirements, refunds, taxes, chargebacks, and compliance holds described in these Terms, the Contest Rules, the FAQ, the User Guide, and the room details. Hidden or undisclosed platform fees are not part of SquareKick’s published room rules, and material fee or payout rules should be shown before or during entry purchase.
Texas contest-rule and prize-condition disclosures. For Texas users, each paid room or posted rule set should identify the entry amount, available award amounts or award formula, distribution method, objective evaluation criteria, timing rules, geographic eligibility limits, refund or cancellation conditions, and material conditions required to receive an award before a user commits funds. These disclosures support Texas contest, gift-giveaway, and consumer-protection requirements, including transparency principles reflected in Texas Business and Commerce Code Chapters 17 and 621.
Winner determination and prize payout math are described in the room rules. Under Skill Card scoring, straight and reverse prize slots are ranked by the room’s locked Combined Score, using normalized Skill Card score and square/digit score at the configured weights. When a room uses posted straight/reverse digit rules, that posted process explains how straight/reverse score digits are applied. Payouts may be delayed, adjusted, held, or withheld only as allowed by the Terms, rules, payment-provider requirements, tax obligations, dispute review, fraud prevention, or applicable law.
Fair play, bots, and misleading-practices prohibition. SquareKick prohibits unauthorized automated software, scripts, bots, collusion rings, fake accounts, account sharing, match manipulation, score manipulation, payment manipulation, or any practice that misrepresents contest mechanics, disguises non-human participation as real-user participation, manipulates outcomes, hides material fees, or otherwise creates a deceptive or unconscionable user experience under Texas consumer-protection law.
Age Verification and Ledger Liquidation. Texas residents and users located in Texas must be at least 18 years old to register, open an account, deposit money, fund entries, enter paid game rooms, receive winner awards, request withdrawals, or use payout features. By registering or participating, the user represents that the user is at least 18 and has legal capacity to enter these Terms. SquareKick may require age, identity, payment, payout, tax, device, account, or location verification before allowing participation or releasing funds. If SquareKick determines that an account was created, operated, funded, or used by a minor or by a person misrepresenting age or identity, SquareKick may immediately suspend or terminate the account, cancel entries, void awards, preserve or void game histories as compliance records, deactivate the profile, and liquidate or forfeit deposited funds, virtual ledger balances, prizes, or other benefits to the maximum extent permitted by applicable law.
Texas SCOPE Act and minor-access restrictions. SquareKick is designed for adults only. Individuals under 18 are strictly prohibited from creating accounts, depositing funds, entering paid contests, receiving winner awards, using payout features, or submitting personal data for paid participation. SquareKick may use age-verification, identity-verification, account-review, and device or location controls to enforce this adult-only policy and to avoid knowingly processing minor data in a manner restricted by the Texas SCOPE Act or other child-safety laws.
Jurisdictional Geofencing Consent and Prohibitions. Where Texas participation is offered, SquareKick may require continuous, event-time, or transaction-time location verification to access paid game rooms. Verification may include GPS permission signals, IP address, IP triangulation, device signals, browser location permission, network signals, payment or payout location indicators, and fraud-prevention checks. Users consent to these checks as a condition of accessing paid rooms and payout features. If location cannot be verified, if the user appears to be outside a permitted jurisdiction, or if applicable state, federal, local, venue, tribal, payment-service, app-store, or other restrictions prohibit participation, SquareKick may block room entry, hold or delay payouts, cancel entries, or restrict account activity.
Identity-theft and location-verification controls. To protect against identity theft, account takeover, underage access, restricted-state access, payment fraud, and payout fraud, Texas users may be required to verify legal name, date of birth, account ownership, payment or payout ownership, Taxpayer Identification Number status where required, device information, and physical location. Verification may use trusted identity databases, payment services, payout services, fraud-prevention tools, and geolocation services, and refusal or failure to complete verification may prevent paid participation or payout release.
Strict Anti-VPN and Anti-Spoofing Protections. Using a VPN, proxy, emulator, remote desktop, GPS spoofing tool, false device signal, location-masking software, account sharing, false identity, or other method to mask, falsify, or manipulate Texas physical presence or eligibility is a material breach of these Terms. SquareKick may immediately lock, suspend, or terminate the account, ban the user from game rooms, cancel entries, void awards, hold balances, delay payouts, and forfeit deposits, prize balances, virtual balances, or other benefits where permitted by law.
Withdrawal, anti-money-laundering, and money-services limits. Deposited funds may be used only for eligible SquareKick entries and platform transactions. User-to-user fund transfers, peer remittances, off-platform settlement arrangements, chip-dumping, deliberate losing, collusive entries, chargeback abuse, and attempts to use SquareKick as a money-transmission or banking utility are strictly prohibited. Withdrawals are subject to fraud review, identity verification, tax checks, payment-service rules, chargeback review, and may be limited to the original payment method or a verified bank or payout account belonging to the registered account holder.
Texas tax and reporting notice. Texas does not currently impose a personal state income tax on individual prize winnings, but users remain solely responsible for all federal, state, local, and other taxes associated with winner awards. SquareKick may require W-9, SSN, ITIN, or other taxpayer-identification information and may issue IRS Form 1099-MISC or other legally required tax reports for reportable prize activity. SquareKick may also track Texas-related receipts and transactions for its own business, franchise-tax, accounting, and compliance obligations.
Electronic contracting and consent to electronic records. Pursuant to the Texas Uniform Electronic Transactions Act, Texas Business and Commerce Code Chapter 322, by clicking “I Agree,” registering, entering a room, funding an entry, submitting a Skill Card, requesting a withdrawal, or otherwise using SquareKick, the user agrees that electronic records, electronic notices, and electronic signatures have the same legal effect as paper records and handwritten signatures, and consents to receive required disclosures electronically where permitted by law.
Texas consumer-protection and privacy non-waiver. SquareKick works to avoid deceptive, misleading, unfair, ambiguous, hidden, or unconscionable practices by publishing clear rules, fee disclosures, privacy disclosures, award conditions, geographic eligibility limits, refund rules, support paths, and dispute-resolution procedures. Texas privacy rights, sensitive-data consent requirements, geolocation disclosures, profiling and targeted-advertising opt-outs, consumer request rights, appeal rights, breach-notification procedures, fee/rake disclosures, prize rules, and consumer protections are described in these Terms, the Privacy Policy, the Contest Rules, the FAQ, and the User Guide. Nothing in these Terms waives non-waivable Texas consumer-protection, privacy, security, contest, age, geolocation, dispute-resolution, or statutory rights where applicable.
15. Virginia Participation, Privacy, Consumer Protection, and Geofencing Terms
Virginia residents and users located in Virginia remain subject to all eligibility, age, geofencing, payment, payout, tax, consumer-protection, privacy, contest, prize, and responsible-play requirements that apply to their attempted access or participation. SquareKick does not represent that paid-entry rooms, real-money contest features, wallet features, withdrawal features, prize features, promotional features, or other participation features are available or lawful for Virginia users.
Exclusion of Virginia paid-entry participation. The Application is not available to, and may not be used by, individuals physically located within the Commonwealth of Virginia for paid-entry tournaments, real-money rooms, cash-prize rooms, deposits, entry-fee payments, or prize claims unless SquareKick later obtains and implements a lawful authorization, registration, license, or operating structure expressly permitting such access. If you are located in Virginia, you are prohibited from depositing funds, paying entry fees, entering paid rooms, or claiming cash prizes through SquareKick.
Virginia gambling-law acknowledgment. Virginia law defines illegal gambling broadly and includes the playing or offering for play of certain skill games within its gambling framework. SquareKick does not authorize any user to use the platform for unlawful gambling, unauthorized online wagering, side bets, bookmaking, pooled betting outside posted room rules, disguised sports betting, illegal internet gambling, or any activity prohibited by Virginia law, including Va. Code 18.2-325 et seq.
Restricted-state enforcement. Paid-entry rooms are void where prohibited. If SquareKick determines that a user is physically located in Virginia or otherwise ineligible under Virginia law, SquareKick may block access to paid rooms, reject deposits, cancel entries, void awards, withhold payouts, suspend or terminate the account, reverse transactions, require additional verification, preserve compliance records, or handle remaining balances as required or permitted by law, payment rules, fraud-prevention standards, and these Terms.
Skill-contest and non-wagering structure outside restricted access. Where SquareKick offers paid-entry rooms in permitted jurisdictions, they are intended as skill-predominant sports knowledge and matchup-analysis contests and not as a casino, sportsbook, lottery, internet gambling service, game of chance, or unauthorized wagering service. Users may not treat entries as wagers on sports outcomes or use SquareKick to facilitate third-party betting, side pools, bookmaking, or unauthorized gambling.
Contest rules, fees, and scoring transparency. All paid-entry rooms are governed by the specific rules, time limits, Skill Card scoring rules, square/digit scoring rules, tiebreakers, prize terms, and eligibility requirements displayed within the room interface, Contest Rules, FAQ, User Guide, and related disclosures. SquareKick aims to present entry fees, administrative/platform fees, prize pools, straight and reverse award structures, payout timing, refund handling, withdrawal limits, and dispute procedures in a clear and conspicuous manner before users commit funds.
No post-entry manipulation. SquareKick prohibits retroactive modification of room rules, deadlines, scoring matrices, tiebreakers, or prize values after an entry fee has been submitted, except where a correction is reasonably necessary to address an error, fraud, outage, legal requirement, restricted-state access issue, payment issue, payout issue, or contest-integrity issue. Rules are intended to be enforced uniformly and objectively across participants.
Virginia consumer-protection disclosures. SquareKick intends to comply with Virginia consumer-protection standards by avoiding deceptive pricing, hidden administrative fees, misleading room descriptions, misleading prize claims, undisclosed withdrawal requirements, false player-identity representations, and other deceptive or unfair practices. Fair play and prohibited automation. SquareKick is intended for real, verified human participants. Users may not use bots, artificial intelligence scripts, macros, scrapers, automated entry tools, multiple accounts, account sharing, collusion, match manipulation, payment abuse, chargeback abuse, location spoofing, VPN or proxy masking, identity misrepresentation, or any other tool or conduct that manipulates room outcomes, scoring, participant eligibility, payments, payouts, or platform security.
Geolocation, identity, and age verification. To enforce restricted-state rules and protect the platform, users authorize SquareKick and its vendors to verify identity, age, account ownership, payment eligibility, and physical location using information such as IP address, device data, GPS or other location signals, payment records, identity-verification data, and fraud-prevention databases. Any attempt to hide, spoof, or manipulate physical location, identity, age, payment source, or account ownership may result in denial of entry, suspension, termination, refund denial where legally permitted, prize withholding, or other compliance action.
Payments, wallet restrictions, withdrawals, and AML controls. Wallet balances may be used only for authorized SquareKick entries, refunds, payouts, withdrawals, or other platform-supported purposes. User-to-user transfers, third-party remittance, stored-value misuse, money-laundering activity, chip-dumping, collusion, fraudulent deposits, payment abuse, and withdrawals to accounts not associated with the verified user are prohibited. Withdrawals may be subject to identity verification, source-of-funds review, fraud review, chargeback review, tax-support review, and payment-processor requirements.
Taxes and reporting. Users are responsible for all federal, state, and local taxes associated with prizes or other amounts received through SquareKick. SquareKick may request a Social Security number, Individual Taxpayer Identification Number, Form W-9 information, or other tax-support information when required to support IRS Form 1099-MISC reporting, backup withholding, fraud prevention, payout compliance, or other legal obligations. SquareKick may withhold or delay payouts where tax-support information is missing, inaccurate, incomplete, or legally required.
Electronic contracting. Pursuant to the Virginia Uniform Electronic Transactions Act, Va. Code 59.1-479 et seq., by registering, clicking an acceptance checkbox, entering a room where permitted, submitting a Skill Card, paying an entry fee where permitted, using wallet features, requesting a payout, or otherwise using SquareKick, users consent to electronic signatures, electronic records, and electronic delivery of notices, disclosures, terms, tax-support requests, privacy notices, and transaction records.
Disputes and non-waiver. Users must use the support, dispute, and appeal procedures provided by SquareKick for payment, payout, scoring, geolocation, account, privacy, fraud-review, tax-support, and eligibility disputes. Nothing in these Terms waives any non-waivable Virginia consumer-protection, privacy, data-security, contest, age, geolocation, payment, payout, tax, dispute-resolution, or statutory rights where applicable.
16. Georgia Participation, Privacy, Consumer Protection, and Geofencing Terms
Georgia residents and users located in Georgia remain subject to all eligibility, age, geofencing, payment, payout, tax, consumer-protection, privacy, contest, prize, and responsible-play requirements that apply to their participation. SquareKick does not represent that every room, contest structure, prize feature, wallet feature, withdrawal feature, promotional feature, or real-money participation feature is available or lawful for every Georgia user or in every Georgia location.
Georgia eligibility and pure-skill representation. Paid-entry rooms offered to users physically located in Georgia are intended to be structured strictly as contests of skill. By registering, funding an entry, or entering a paid room from Georgia, the user represents and warrants that the outcome of the room relies on the user's personal skill, sports knowledge, strategy, timing, analysis, and execution, and is not being used as a wager, lottery, sportsbook entry, bookmaking transaction, gambling pool, or chance-based game.
No chance-based structure. SquareKick does not authorize Georgia users to participate in any room in a manner that depends on chance, luck, random drawings, random winner selection, side betting, bookmaking, pooled betting outside posted room rules, or any mechanical, electronic, or digital gambling structure prohibited by Georgia law, including O.C.G.A. 16-12-20 et seq. If a Georgia user believes that local law, a room format, or a platform feature makes participation unlawful, the user must not enter that room.
Fixed, predetermined prizes and neutral-host role. Georgia paid-entry rooms must disclose the applicable prize amounts, winner-award rules, scoring rules, deadlines, and eligibility requirements before entry. Prize amounts are intended to be fixed, predetermined, and guaranteed by the platform before entry-fee collection for the applicable room, and not to fluctuate based on the live number of participants or the final amount of entry fees collected. SquareKick acts as a neutral host and does not participate as a competing player in its own paid rooms.
Contest rules and scoring transparency. All paid-entry rooms are governed by the specific rules, time limits, Skill Card scoring rules, square/digit scoring rules, tiebreakers, prize terms, and eligibility requirements displayed within the room interface, Contest Rules, FAQ, User Guide, and related disclosures. Winners are determined through objective platform scoring and posted room rules. SquareKick prohibits retroactive modification of tournament rules, deadlines, scoring matrices, tiebreakers, or prize values after an entry fee has been submitted, except where a correction is reasonably necessary to address an error, fraud, outage, legal requirement, or integrity issue.
Georgia consumer-protection disclosures. SquareKick intends to comply with the Georgia Fair Business Practices Act and related consumer-protection standards by providing clear disclosures about entry fees, administrative fees, prize terms, withdrawal requirements, refund rules, geographic eligibility, scoring criteria, and dispute-resolution procedures before users commit funds. Users must not rely on any statement outside the official room rules, Terms, Privacy Policy, Contest Rules, FAQ, User Guide, and platform disclosures.

17. Colorado Participation, Privacy, Consumer Protection, and Geofencing Terms
Colorado residents and users physically located in Colorado remain subject to all eligibility, age, geofencing, payment, payout, tax, consumer-protection, privacy, contest, prize-disclosure, identity-verification, anti-fraud, and responsible-play requirements that apply to their participation. SquareKick does not represent that every room, contest structure, prize feature, wallet feature, withdrawal feature, promotional feature, or real-money participation feature is available or lawful for every Colorado user or in every Colorado location.
Colorado bona fide contest and skill warranty. Pursuant to Colorado Revised Statutes 18-10-102(1)(a), paid-entry tournaments offered to Colorado users are intended to be structured as bona fide contests of skill, speed, strength, or endurance in which awards are made only to entrants or owners of entries. By participating, Colorado users represent and warrant that the tournament outcome depends predominantly on individual skill, knowledge, strategy, matchup analysis, Skill Card performance, and objective scoring, rather than chance, random number generation, server-side randomness, card deals, random layouts, or other luck-based events.
No betting, wagering, gambling pool, or house-banked structure. SquareKick is intended to operate as a peer-to-peer skill-based sports knowledge and matchup-analysis contest, not as a sportsbook, casino, lottery, house-banked game, parimutuel pool, unauthorized gambling service, gambling pool, bookmaking service, or wagering service. Users may not use SquareKick to place bets, side wagers, off-platform pools, bookmaking arrangements, or any arrangement in which a person wins or loses something of value based on chance rather than skill.
Fixed prize, predetermined award, and neutral-host conditions. All applicable prize amounts, room rules, scoring criteria, award allocations, deadlines, and eligibility conditions must be fixed, predetermined, guaranteed, and disclosed before entry fee collection. Prize amounts must not vary based on real-time participant counts or the live count of collected entry fees, and SquareKick acts solely as a neutral host. SquareKick does not participate as a competitor, wager against users, operate a house-banked room, or run a parimutuel-style payout structure.
Contest rules, fees, and scoring transparency. All paid-entry matches are governed by the specific rules, time limits, fee disclosures, scoring matrices, Skill Card scoring rules, square/digit scoring components, prize allocations, winner-ranking rules, and tiebreakers displayed within each room or applicable rules page before entry. Winners are determined through objective, automated system evaluations of player performance metrics and locked room rules. SquareKick prohibits random drawings, chance-based tiebreakers, retroactive modifications to rules, deadlines, eligibility terms, scoring metrics, or prize values after entry, and any off-platform pool, side wager, bookmaking arrangement, or private agreement connected to a SquareKick room.
Uniform rule enforcement and no manipulative contest operations. Rules are enforced uniformly and objectively across participants. SquareKick prohibits alibi-style rule manipulation, selective enforcement, hidden scoring rules, undisclosed judging criteria, undisclosed bots, artificial traffic inflation, manipulated matchups, delayed scoring manipulation, or any deceptive practice that misrepresents the nature of the contest, the odds of success, the fee structure, the prize amount, the scoring method, the identity of participants, or the ability to withdraw funds.
Fair play and bot prohibition. The use of automated software, artificial intelligence systems, scripts, bots, macros, scraping tools, collusion, coordinated entries, multi-accounting, false identities, credential sharing, device manipulation, payment manipulation, payout manipulation, or any tool or conduct designed to manipulate room entry, Skill Card submissions, square selection, score processing, winner ranking, wallet records, or payout records is strictly prohibited. SquareKick may investigate suspicious conduct and may cancel entries, void awards, hold payouts, restrict accounts, or terminate access where permitted by law and posted rules.
Age restriction and minor prohibition. Colorado users must be at least 18 years old to register, open an account, deposit money, fund entries, enter paid rooms, receive winner awards, request withdrawals, or use payout features. Individuals under 18 are strictly prohibited from creating accounts, depositing funds, or participating in paid-entry rooms. Any account discovered to belong to a minor, or to have been created or used through misrepresented identity or age, may be immediately suspended, permanently deactivated, restricted, or terminated, and SquareKick may cancel entries, void awards, preserve compliance records, and handle balances as permitted by law and posted rules.
Identity and location verification. To participate in paid-entry rooms, Colorado users consent to age, identity, device, payment, payout, tax, and physical-location verification. Verification may include third-party verification providers, GPS permission signals, IP address, browser or app location permission, cellular or network signals, device signals, payment or payout location indicators, identity databases, and fraud-prevention checks. If location or identity cannot be verified, if the user appears to be in a restricted jurisdiction, or if applicable law prohibits participation, SquareKick may block entry, cancel or refund entries, hold or delay payouts, or restrict account activity.
Sensitive data and location consent for participation. Colorado participation may require affirmative consent to collect and process precise geolocation data and related sensitive data for eligibility, geofencing, fraud prevention, payment, payout, tax-support, security, and legal-compliance purposes. Refusing or disabling location permission, identity checks, age checks, payment verification, payout verification, or tax-support verification may prevent access to paid-entry rooms, wallet features, prize claims, or withdrawals.
Strict anti-VPN and location-masking prohibition. Using a VPN, proxy, emulator, remote desktop, GPS-spoofing tool, false device signal, location-masking software, false identity, account sharing, or any other method to hide, falsify, or manipulate physical location, age, identity, or eligibility is a material breach of these Terms. SquareKick may immediately lock, suspend, or terminate the account, cancel entries, void awards, hold balances, delay payouts, restrict room access, preserve records, and forfeit deposits, prize balances, or other benefits where permitted by law.
Wallet, withdrawal, anti-money laundering, and no user-to-user transfer rules. Wallet balances may be used only for SquareKick entries, refunds, withdrawals, and other posted platform purposes. Peer-to-peer fund transfers, user-to-user remittances, off-platform settlement, chip dumping, deliberate losing, chargeback abuse, laundering, collusion, payment fraud, payout mismatches, and attempts to use SquareKick as a money-transmission or banking utility are prohibited. Withdrawals may be limited to verified payment methods, payout accounts, or banking channels matching the account holder identity and are subject to fraud, identity, tax, payment, payout, and compliance review.
Colorado tax obligations and reporting. Users are solely responsible for all federal, Colorado, and other applicable tax obligations associated with winner awards and other reportable amounts. SquareKick may collect tax-support information, require verified tax setup, issue IRS Form 1099-MISC where required, delay payouts pending tax review, apply backup withholding where required, and report payments to the Internal Revenue Service, the Colorado Department of Revenue, or other authorities where required by law.
Electronic contracting and communications. Pursuant to the Colorado Uniform Electronic Transactions Act, C.R.S. 24-71.3-101 et seq., by registering an account, clicking an acceptance box, entering a paid room, submitting a Skill Card, funding an entry, or otherwise using SquareKick, the user agrees to conduct transactions electronically and acknowledges that electronic records, signatures, notices, disclosures, and communications may have legal effect. Users should not use SquareKick if they do not agree to receive required terms, privacy notices, contest rules, payment notices, payout notices, tax notices, and other communications electronically.
Disputes, privacy, and non-waiver. Colorado privacy rights, data-security requirements, contest and prize disclosures, consumer-protection obligations, geolocation rules, age and eligibility restrictions, payment and prize restrictions, tax obligations, electronic-contracting rules, and account remedies are described in these Terms, the Privacy Policy, the Contest Rules, the FAQ, and the User Guide. Nothing in these Terms waives any non-waivable Colorado consumer-protection, privacy, security, contest, prize, payment, tax, geolocation, or statutory right where applicable.
18. Washington Participation, Privacy, Consumer Protection, and Geofencing Terms
Washington residents and users physically located in Washington remain subject to all eligibility, age, geofencing, payment, payout, tax, consumer-protection, privacy, contest, prize-disclosure, identity-verification, anti-fraud, and responsible-play requirements that apply to their participation. SquareKick does not represent that every room, contest structure, prize feature, wallet feature, withdrawal feature, promotional feature, or real-money participation feature is available or lawful for every Washington user or in every Washington location.
Washington paid-entry exclusion and geofencing. Because Washington applies strict gambling and internet-gambling rules, SquareKick may prohibit Washington residents and individuals physically located in Washington from depositing funds, paying entry fees, joining paid-entry rooms, or receiving cash-equivalent winner awards unless SquareKick determines that the applicable feature is lawful and available. If a user resides in Washington or is physically located in Washington, the user must not attempt to access paid-entry tournaments, real-money rooms, deposits, or cash-prize features that SquareKick has restricted. SquareKick may block, cancel, refund, void, suspend, terminate, or geofence participation where required by Washington law, SquareKick policy, provider restrictions, or compliance review.
Washington skill-contest and no-chance acknowledgment. SquareKick is intended to operate as a peer-to-peer skill-based sports knowledge and matchup-analysis contest, not as a sportsbook, casino, lottery, house-banked game, parimutuel pool, unauthorized gambling service, gambling pool, bookmaking service, or wagering service. Where any Washington participation is permitted, the user represents and warrants that the applicable tournament outcome is determined by personal skill, knowledge, strategy, matchup analysis, Skill Card performance, objective scoring, and posted tiebreaker rules, and that chance, random drawings, selection loops, random layouts, random matching, server-latency manipulation, or future contingent events outside the user control do not affect the outcome to a material degree.

Washington consumer protection, fair play, and transparent fees. SquareKick will display applicable room rules, entry costs, platform fees, administrative deductions, payout timing, withdrawal conditions, refund rules, prize values, scoring rubrics, tiebreakers, and material user obligations before a user confirms a paid entry. SquareKick prohibits unfair or deceptive acts or practices, deceptive pricing, hidden withdrawal fees, misleading statements about odds or likely winnings, misrepresented matchmaking mechanics or latency, inflated player traffic, undisclosed automated opponents, house bots, or any other deceptive practice. The use of automated scripts, scraping tools, AI systems, bots, macros, unauthorized software, multiple accounts, credential sharing, or other tools to manipulate room entry, Skill Card submissions, square selection, score processing, winner ranking, wallet records, or payout records is strictly prohibited.

Washington does not currently impose a personal state income tax on individuals, but federal reporting rules still apply. SquareKick may collect tax-support information, require verified tax setup, issue IRS Form 1099-MISC where required, delay payouts pending tax review, apply backup withholding where required, and report payments to the Internal Revenue Service, the Washington Department of Revenue, or other authorities where required by law.
Electronic contracting and communications. Pursuant to the Washington Uniform Electronic Transactions Act, RCW Chapter 1.80, by registering an account, clicking an acceptance box, entering a paid room, submitting a Skill Card, funding an entry, or otherwise using SquareKick, the user agrees to conduct transactions electronically and acknowledges that electronic records, signatures, notices, disclosures, and communications may have legal effect. Users should not use SquareKick if they do not agree to receive required terms, privacy notices, contest rules, payment notices, payout notices, tax notices, and other communications electronically.

19. Oklahoma Participation, Privacy, Consumer Protection, and Geofencing Terms
Oklahoma residents and users physically located in Oklahoma remain subject to all eligibility, age, geofencing, payment, payout, tax, consumer-protection, privacy, contest, prize-disclosure, identity-verification, anti-fraud, and responsible-play requirements that apply to their participation. SquareKick does not represent that every room, contest structure, prize feature, wallet feature, withdrawal feature, promotional feature, or real-money participation feature is available or lawful for every Oklahoma user or in every Oklahoma location.
Oklahoma skill-contest and statutory-exemption acknowledgment. SquareKick is intended to operate as a peer-to-peer skill-based sports knowledge and matchup-analysis contest, not as a sportsbook, casino, lottery, house-banked game, parimutuel pool, unauthorized gambling service, gambling pool, bookmaking service, or wagering service. Paid-entry tournaments offered to Oklahoma users are intended to qualify as bona fide contests of skill where entry fees do not constitute a bet under Oklahoma Statutes Title 21, Section 981(1)(c). By entering a paid room from Oklahoma, the user represents and warrants that the tournament outcome depends predominantly on the individual user skill, strategy, knowledge, matchup analysis, Skill Card performance, objective scoring, and posted tiebreaker rules rather than chance.

Wallet, withdrawal, anti-money laundering, and no user-to-user transfer rules. Wallet balances may be used only for SquareKick entries, refunds, withdrawals, and other posted platform purposes. Peer-to-peer fund transfers, user-to-user remittances, off-platform settlement, chip dumping, deliberate losing, chargeback abuse, laundering, collusion, payment fraud, payout mismatches, and attempts to use SquareKick as a money-transmission or banking utility are prohibited. Withdrawals may be limited to verified payment methods, payout accounts, or banking channels matching the account holder identity and are subject to fraud, identity, tax, payment, payout, and compliance review.

Prize amounts must not vary based on real-time participant counts or the live count of collected entry fees, and SquareKick acts solely as a neutral host. SquareKick does not participate as a competitor, wager against users, operate a house-banked room, or run a parimutuel-style payout structure.
Tournament rules and objective scoring metrics. All matches offered to New York users are structured as objective skill competitions. Winners are determined solely through automated system tracking of locked room rules, Skill Card scores, square/digit scoring components, objective performance metrics, and posted tiebreakers. SquareKick is intended to operate as a peer-to-peer skill-based sports knowledge and matchup-analysis contest, not as a sportsbook, casino, lottery, gambling pool, house-banked game, bookmaking product, unauthorized gaming table, or parimutuel wagering product. Paid-entry rooms offered to D.C. users are intended to be structured as pure contests of skill in which winner determination depends on participant skill, strategy, matchup analysis, Skill Card performance, objective scoring, and posted tiebreaker rules rather than on chance, random drawing, lottery mechanics, bookmaking, or house-backed betting.
No chance, no random drawing, fixed prize, and neutral host conditions. By entering a paid room from the District of Columbia, the user represents and warrants that the user understands that the applicable room must not use random drawings, gambling pools, bookmaking, or chance-based winner selection to award prizes. All applicable prize amounts, room rules, scoring criteria, award allocations, deadlines, and eligibility conditions must be fixed, predetermined, guaranteed, and disclosed before entry fee collection. SquareKick acts as a neutral platform host and does not wager against users, adjust payouts based on live participant counts, or participate as a competitor in its own rooms.
Tournament evaluation and scoring transparency. All paid-entry matches are governed by the specific rules, time limits, Skill Card scoring settings, square/digit scoring settings, tiebreaker order, prize values, fee disclosures, and award distribution terms shown in the applicable game room, Contest Rules, FAQ, User Guide, and other posted disclosures before entry. Winner determinations are made through objective system evaluations of player performance metrics and locked room configuration. In the event of an exact tie, pre-established objective tiebreaker protocols apply. SquareKick never uses random drawings to determine the winner of a paid-entry contest.
No post-entry rule manipulation. SquareKick does not permit material modification of tournament rules, deadlines, scoring criteria, prize values, or eligibility conditions after a user has submitted an entry fee, except where required for cancellation, refund, fraud review, system-failure handling, legal compliance, responsible-play intervention, or other posted remedies. Users may not request or participate in side bets, private wagers, off-platform pools, collusion, chip dumping, deliberate losing, or any other arrangement that could cause a room to be treated as a gambling pool, lottery, wager, or unauthorized gaming activity under D.C. law.
D.C. consumer protection, transparent fees, and fair play. SquareKick aims to clearly disclose entry fees, administrative/platform fees, prize pools, payout conditions, withdrawal timelines, refund rules, scoring mechanics, and user obligations before a user confirms a paid entry. SquareKick prohibits false or misleading statements about odds, expected winnings, player traffic, prize availability, fee deductions, automated opponents, bots, or matchmaking. The use of automated house bots, scripts, scraping tools, AI systems, macros, unauthorized software, multiple accounts, credential sharing, or other tools to manipulate room entry, Skill Card submissions, square selection, score processing, winner ranking, wallet records, or payout records is strictly prohibited.
Age limitation and minor prohibition. D.C. users must be at least 18 years old to register, open an account, deposit money, fund entries, enter paid rooms, receive winner awards, request withdrawals, or use payout features. Minors under 18 are strictly prohibited from creating accounts, depositing money, or participating in paid rooms. Any account discovered to belong to a minor, or to have been created or used through misrepresented identity or age, may be immediately suspended, permanently deactivated, restricted, or terminated, and SquareKick may cancel entries, void awards, preserve compliance records, and handle balances as permitted by law and posted rules.
Geolocation, account identity validation, and anti-spoofing consent. To access paid-entry rooms, D.C. users consent to age, identity, device, payment, payout, tax, and exact physical-location verification. Verification may include third-party verification providers, GPS permission signals, IP address, browser or app location permission, cellular or network signals, device signals, payment or payout location indicators, identity databases, and fraud-prevention checks. If location or identity cannot be verified, if the user appears to be in a restricted jurisdiction, or if applicable law prohibits participation, SquareKick may block entry, cancel or refund entries, hold or delay payouts, or restrict account activity.
Strict anti-VPN and location-masking prohibition. Using a VPN, proxy, emulator, remote desktop, GPS-spoofing tool, false device signal, location-masking software, false identity, account sharing, or any other method to hide, falsify, or manipulate physical location, age, identity, or eligibility is a material breach of these Terms. SquareKick may immediately lock, suspend, or terminate the account, cancel entries, void awards, hold balances, delay payouts, restrict room access, preserve records, and forfeit deposits, prize balances, or other benefits where permitted by law.
Wallet, withdrawal, anti-money laundering, and no user-to-user transfer rules. Wallet balances may be used only for SquareKick entries, refunds, withdrawals, and other posted platform purposes. Peer-to-peer fund transfers, user-to-user remittances, off-platform settlement, chip dumping, deliberate losing, chargeback abuse, laundering, collusion, payment fraud, payout mismatches, and attempts to use SquareKick as a money-transmission or banking utility are prohibited. Withdrawals may be limited to verified payment methods, payout accounts, or banking channels matching the account holder’s identity and are subject to fraud, identity, tax, payment, payout, and compliance review.
D.C. tax obligations and reporting. Users are solely responsible for all federal, District of Columbia, and other applicable tax obligations associated with winner awards and other reportable amounts. D.C. may impose local individual income tax obligations on prize winnings. SquareKick may collect tax-support information, require verified tax setup, issue IRS Form 1099-MISC or another required tax form, delay payouts pending tax review, apply backup withholding where required, and report payments to the Internal Revenue Service, the D.C. Office of Tax and Revenue, or other authorities where required by law.
Electronic contracting and communications. Pursuant to the District of Columbia Uniform Electronic Transactions Act, including D.C. Official Code § 28-4906, by registering an account, clicking an acceptance box, entering a paid room, submitting a Skill Card, funding an entry, or otherwise using SquareKick, the user agrees to conduct transactions electronically and acknowledges that electronic records, signatures, notices, disclosures, and communications may have legal effect. Users should not use SquareKick if they do not agree to receive required terms, privacy notices, contest rules, payment notices, payout notices, tax notices, and other communications electronically.
Disputes, privacy, and non-waiver. D.C. privacy rights, data-security requirements, breach-notification obligations, contest and prize disclosures, consumer-protection obligations, geolocation rules, age and eligibility restrictions, payment and prize restrictions, tax obligations, electronic-contracting rules, and account remedies are described in these Terms, the Privacy Policy, the Contest Rules, the FAQ, and the User Guide. Nothing in these Terms waives any non-waivable District of Columbia consumer-protection, privacy, security, contest, prize, payment, tax, geolocation, or statutory right where applicable.
24. Illinois Participation, Privacy, Consumer Protection, and Geofencing Terms
Illinois residents and users located in Illinois remain subject to all eligibility, age, geofencing, payment, payout, tax, consumer-protection, privacy, contest, prize-disclosure, biometric, identity-verification, anti-fraud, and responsible-play requirements that apply to their participation. SquareKick does not represent that every room, contest structure, prize feature, wallet feature, withdrawal feature, promotional feature, or real-money participation feature is available or lawful for every Illinois user or in every Illinois location.
Illinois bona fide contest acknowledgment. SquareKick is intended to operate as a peer-to-peer skill-based sports knowledge and matchup-analysis contest, not as a sportsbook, casino, lottery, house-banked game, unauthorized gambling service, or parimutuel wagering product. Pursuant to the bona fide contest concept reflected in 720 ILCS 5/28-1(b)(2), paid-entry rooms offered to Illinois users are intended to be structured so that winner determination depends predominantly on participant skill, strategy, matchup analysis, Skill Card performance, scoring/tiebreaker performance, and posted room rules rather than on unauthorized wagering or house-backed betting.
Fixed prize, neutral host, and no house participation. By entering a paid room from Illinois, the user represents and warrants that the user understands that all applicable prize amounts, room rules, scoring criteria, award allocations, deadlines, and eligibility conditions must be fixed, guaranteed, and fully disclosed before entry fee collection. SquareKick acts as a neutral platform host and does not participate as a competitor in its own rooms. Users may not create, request, or participate in side bets, private wagers, pooled betting outside posted room rules, bookmaking, collusion, or any other activity that could cause a room to be treated as illegal gambling under Illinois law.
Contest terms, rules, and prize disclosures. All paid-entry matches are governed by the specific rules, time constraints, Skill Card scoring settings, square/digit scoring settings, tiebreaker order, prize values, fee disclosures, and award distribution terms shown in the applicable game room, Contest Rules, FAQ, User Guide, and other posted disclosures before entry. Winner determinations are made through objective system evaluations of player performance metrics and locked room configuration. If SquareKick or a supported provider uses biometric verification for Illinois users to prevent fraud, multi-accounting, account takeover, or contest-integrity abuse, participation may require separate biometric disclosures and consent as described in the Illinois Consumer Privacy Notice. Refusal or withdrawal of required verification consent may limit access to paid rooms, payouts, withdrawals, or account recovery where verification is necessary for security, fraud prevention, or legal compliance.
Tax obligations. Users are solely responsible for federal, state, and local taxes associated with winner awards and other reportable amounts. Illinois may impose state income tax obligations on prize winnings. SquareKick may collect tax-support information, require verified tax setup, issue IRS Form 1099-MISC or another required tax form, delay payouts pending tax review, apply backup withholding where required, and report payments to the Internal Revenue Service, the Illinois Department of Revenue, or other authorities where required by law.
Electronic contracting and communications. Pursuant to the Illinois Uniform Electronic Transactions Act, 815 ILCS 333/1 et seq., by registering an account, clicking an acceptance box, entering a paid room, submitting a Skill Card, funding an entry, or otherwise using SquareKick, the user agrees to conduct transactions electronically and acknowledges that electronic records, signatures, notices, disclosures, and communications may have legal effect. Users should not use SquareKick if they do not agree to receive required terms, privacy notices, contest rules, payment notices, payout notices, tax notices, and other communications electronically.
Disputes, privacy, and non-waiver. Illinois privacy rights, BIPA and PIPA disclosures, data-security requirements, breach-notification obligations, contest and prize disclosures, consumer-protection obligations, geolocation rules, age and eligibility restrictions, payment and prize restrictions, tax obligations, electronic-contracting rules, and account remedies are described in these Terms, the Privacy Policy, the Contest Rules, the FAQ, and the User Guide. Nothing in these Terms waives any non-waivable Illinois consumer-protection, privacy, biometric, security, contest, prize, payment, tax, geolocation, or statutory right where applicable.
25. California Participation, Privacy, Consumer Protection, and Geofencing Terms
California residents and users physically located in California remain subject to all eligibility, age, location, payment, payout, tax, privacy, consumer-protection, contest, prize, and promotional requirements that apply to their participation. SquareKick does not represent that every contest, room, prize structure, wallet feature, withdrawal feature, subscription feature, promotional feature, or service is available or lawful for every California user or in every California locality.
California skill-contest acknowledgment. SquareKick is intended to operate only where permitted as a skill-predominant sports knowledge, matchup-analysis, Skill Card, and square-strategy contest platform. California users acknowledge that SquareKick is not a sportsbook, casino, slot machine, banking game, lottery, pool-selling product, bookmaking product, or house-banked gambling product. Users represent and warrant that paid-entry participation depends predominantly on player skill, strategy, sports knowledge, Skill Card predictions, tiebreaker performance, square-selection decisions, timing decisions, and other posted performance metrics rather than a prohibited game of chance under California Penal Code Sections 319, 330, 337a, or similar laws.
Fixed prize and neutral-host conditions. Paid-entry rooms offered to California users must disclose the applicable entry cost, maximum room size, prize or award structure, Skill Card scoring rules when available, square/digit scoring rules, deadlines, tiebreakers, and objective winner-determination criteria before entry is submitted. Prize structures must be predetermined, guaranteed, and posted before entry-fee collection. SquareKick acts only as a neutral platform host and does not enter rooms as a competing player. SquareKick will not modify contest rules, scoring criteria, deadlines, or prize values after an entry fee has been submitted except where required to correct a verified system error, fraud issue, void contest, legal restriction, or other compliance issue described in these Terms.
California contest transparency. Paid-entry rooms are governed by the rules, scoring matrix, maximum number of participants or entries, deadline, cutoff, room-lock, shuffle, prize-distribution, refund, cancellation, and winner-evaluation terms shown in the room interface and these Terms. SquareKick will not knowingly misrepresent a user’s chance of success, conceal material fees, advertise fake player traffic, use misleading prize claims, or change entry criteria mid-contest in a manner prohibited by California Business and Professions Code Sections 17539.1, 17539.2, 17539.3, the False Advertising Law, or the Unfair Competition Law.
Age restriction and prohibition of minors. Access to paid-entry rooms, deposits, winner awards, withdrawals, and payout features is restricted to users who are at least 18 years old, or older where required by the user’s jurisdiction. Minors under 18 are prohibited from registering, depositing funds, entering paid rooms, submitting Skill Cards for paid rooms, receiving winner awards, or requesting payouts. If a minor circumvents age-gate or verification systems, SquareKick may deactivate the account, cancel or void entries, restrict or delete data where legally permitted, and retain only records reasonably necessary for legal, fraud-prevention, payment, payout, tax, dispute, security, or compliance purposes.
Identity, age, and location verification. To participate in paid-entry rooms, users authorize SquareKick and its trusted verification providers to verify identity, date of birth, physical location, payment eligibility, payout eligibility, device signals, IP address, GPS or browser-location signals, cellular or network signals where available, and fraud-prevention indicators. Paid-entry eligibility is based on the user’s physical location when checkout begins or when a room-entry action requiring verification occurs. Using a VPN, proxy, emulator, remote desktop, GPS-spoofing tool, location-masking software, false identity, account sharing, or similar method to misrepresent location or eligibility is a material breach and may result in account lock, suspension, termination, cancellation of entries, voiding of awards, payout delay, and forfeiture of balances where permitted by law.
Fair play, bot, and automation prohibition. All California paid-entry contests must be played by verified human users. Unauthorized scripts, bots, macros, AI automation used to play or submit entries, multiple accounts, collusion, chip-dumping, deliberate losing, market manipulation, payment abuse, chargeback abuse, abuse of promotions, account sharing, unauthorized access, or any conduct that manipulates room outcomes or scoring integrity is strictly prohibited. SquareKick may audit accounts, withhold withdrawals, void entries, cancel awards, restrict accounts, and report suspicious conduct to payment partners, regulators, law enforcement, or financial institutions where appropriate.
Wallet, withdrawals, anti-money-laundering, and money-services limits. Wallet balances may be used only for lawful SquareKick entries, refunds, winner awards, and verified withdrawals. User-to-user fund transfers, open-loop stored-value use, third-party remittances, cash-equivalent transfer schemes, and attempts to use SquareKick as a banking or money-transmission utility are prohibited. Withdrawals are subject to identity verification, fraud review, chargeback review, payment and payout-provider requirements, tax-support checks, and AML-related review, and may be returned only to an eligible original payment method or verified bank or payout account belonging to the registered account holder.
Fees, refunds, and prize payments. California users must review all displayed entry costs, administrative fees, withdrawal processing information where applicable, refund rules, cancellation rules, and prize or winner-award structures before submitting entry. Entry fees may become non-refundable once play has begun, a room locks, or a contest has materially started, except where refunds, cancellations, voids, chargeback resolutions, system-error corrections, legal restrictions, or platform-failure remedies are required by the room rules, these Terms, payment-provider rules, or applicable law.
California tax reporting. Players are solely responsible for all federal, state, and local tax obligations arising from winner awards or prizes. California may impose state income-tax obligations on California residents or California-source income. SquareKick may require Taxpayer Identification Number information, Form W-9 information, payout-provider tax setup, or other tax-support information through trusted payment or tax providers before releasing certain payouts. SquareKick is configured for U.S. skill-based contest award reporting using IRS Form 1099-MISC only and may issue required tax forms or reports when thresholds or other reporting duties apply.
Electronic contracting and subscription terms. By registering, clicking I Agree, entering a paid room, submitting Skill Card answers, making a payment, requesting a withdrawal, or otherwise using SquareKick, California users consent to conduct transactions electronically and provide an electronic signature under the California Uniform Electronic Transactions Act. If SquareKick later offers recurring subscriptions, premium passes, or automatically renewing features, the applicable renewal terms, price, billing frequency, cancellation method, and required consent disclosures will be presented as required by California’s Automatic Renewal Law.
California privacy and non-waivable rights. California privacy rights and request procedures are described in the Privacy Policy, including the California Consumer Privacy Notice. Nothing in these Terms limits non-waivable rights under the California Consumer Privacy Act, California Privacy Rights Act, Unruh Civil Rights Act, Unfair Competition Law, False Advertising Law, consumer-protection laws, minor-protection laws, or other applicable California law. If any arbitration, class waiver, governing-law, venue, limitation, forfeiture, or other provision is unenforceable for a California user under applicable law, that provision applies only to the maximum extent permitted by law.
26. Nevada Participation, Privacy, Consumer Protection, and Geofencing Terms
Nevada paid-entry exclusion. SquareKick does not offer, authorize, or permit paid-entry contest rooms, deposits, entry-fee payments, cash-prize eligibility, winner awards, withdrawals, or other real-money participation by users who are Nevada residents or who are physically located within the State of Nevada. Paid-entry rooms are void in Nevada. Users must not register for, fund, enter, or claim awards from paid rooms while located in Nevada or if Nevada law prohibits their participation.
Nevada gaming-law acknowledgment. Nevada law regulates gaming, gambling games, interactive gaming, skill-based gaming devices, lotteries, and promotional schemes under frameworks that include the Nevada Gaming Control Act, NRS Chapters 462 and 463, and Nevada Gaming Commission regulations. SquareKick is not a Nevada licensed casino, sportsbook, interactive-gaming operator, gaming device operator, lottery operator, or Nevada gaming establishment. Skill-based or skill-predominant wording in SquareKick rules does not authorize Nevada paid-entry participation and does not override Nevada licensing, geofencing, consumer-protection, payment, or prize restrictions.
User warranty and restricted-state obligation. By creating an account, opening a room page, funding an entry, submitting a Skill Card, selecting a square, requesting a withdrawal, or claiming a winner award, each user represents and warrants that the user is at least 18 years old, is not a Nevada resident, is not physically located in Nevada, is not using a Nevada payment or payout method to evade restrictions, and is not prohibited by applicable law from using SquareKick. Users must immediately stop using paid-entry features if they enter Nevada or become subject to Nevada restrictions.
Geofencing, age, identity, and KYC consent. SquareKick may use multi-factor geolocation, IP address, device or browser location permission, GPS or similar device-derived location, network data, payment and payout location signals, identity-verification databases, age-verification checks, and fraud-prevention tools to determine whether a user may access paid rooms or payout features. Users consent to these checks as a condition of using paid-entry, wallet, withdrawal, and winner-award features. If location, age, identity, payment, payout, or eligibility cannot be verified, SquareKick may block room entry, reject deposits, cancel entries, delay or deny withdrawals, hold balances, restrict accounts, or require additional verification.
Strict anti-VPN, anti-spoofing, and prohibited conduct rules. A user must not use a VPN, proxy, emulator, remote desktop, GPS-spoofing tool, false device signal, false identity, account sharing, payment mismatch, collusion, multi-accounting, chargeback abuse, bot, script, exploit, money-laundering scheme, chip-dumping behavior, side agreement, side bet, or other method to mask Nevada location or evade SquareKick eligibility controls. Violations are a material breach of these Terms and may result in account suspension or termination, cancellation of entries, voiding of awards, payout holds, forfeiture where permitted by law, and reporting to payment partners, regulators, law enforcement, or other appropriate parties.
Fees, prize disclosures, refunds, and consumer-protection transparency. SquareKick aims to display entry fees, administrative/platform fees, prize pools, straight and reverse award structures, Skill Card scoring, square/digit scoring, tiebreakers, payout timing, withdrawal conditions, refund rules, and room-specific rules clearly before a user funds a paid entry. The current financial model uses a 13% administrative/platform fee and 87% player prize allocation unless a specific room or future posted rule displays a different lawful configuration. Entry fees are generally non-refundable once play has commenced, except where SquareKick posts a different rule, cancels a room, verifies a system or platform failure, determines that a refund is legally required, or otherwise approves a refund under posted policies.
Void Nevada participation and prize handling. If SquareKick determines that a Nevada resident, a person physically located in Nevada, or a user using a Nevada location, payment, payout, identity, or device signal entered a paid room or claimed an award, SquareKick may void the entry or award, cancel the room participation, restrict or close the account, reverse or hold transactions, refund eligible deposits where required or appropriate, preserve compliance records, and take any other action permitted by law, payment-service rules, posted room rules, and these Terms.
Electronic contracting and records. By clicking “I Agree,” registering, signing in, funding an entry, submitting a Skill Card, selecting a square, requesting a withdrawal, using the mobile application, or otherwise accessing SquareKick, the user agrees to transact electronically, receive legal disclosures electronically, and provide an electronic signature and consent to electronic records to the extent permitted by Nevada’s Uniform Electronic Transactions Act, NRS Chapter 719, and other applicable law.
Anti-fraud, AML, chargeback, and payout controls. SquareKick may review all accounts, deposits, entry payments, refunds, withdrawals, winner awards, Skill Card submissions, square selections, support records, geolocation signals, payment-service signals, and device data for fraud, chargebacks, collusion, money laundering, identity mismatch, illegal transfers, or prohibited activity. Withdrawals may be limited to verified payment methods, payout accounts, or banking channels matching the account holder’s identity. Suspicious activity may be reported to financial institutions, payment processors, law enforcement, regulators, tax authorities, or other appropriate parties.
Tax obligations. Users are solely responsible for federal, state, and local taxes associated with winner awards and other reportable amounts. Nevada currently does not impose a state personal income tax, but SquareKick may collect tax-support information, require verified tax setup, issue IRS Form 1099-MISC or another required federal tax form, apply backup withholding where required, delay payouts pending tax review, and report payments to the Internal Revenue Service or other authorities where required by law.
Disputes, privacy, and non-waiver. Nevada privacy rights, covered-information opt-out rights, data-security disclosures, geolocation disclosures, consumer-protection obligations, electronic-contracting rules, age and eligibility requirements, payment and prize restrictions, fraud controls, dispute procedures, and account remedies are described in these Terms, the Privacy Policy, the Contest Rules, the FAQ, and the User Guide. Nothing in these Terms waives any non-waivable Nevada consumer-protection, privacy, security, electronic-contracting, gaming, contest, payment, tax, geolocation, or statutory right where applicable. Any dispute involving Nevada restrictions may require SquareKick to preserve records, restrict account activity, or escalate the matter to appropriate regulators, payment partners, or legal authorities.
27. Responsible Play and Real-Money Participation
SquareKick involves paid participation in skill-based sports squares contests. Do not participate if doing so would violate your local law, create financial hardship, or conflict with self-exclusion or responsible gaming commitments that apply to you.
SquareKick should be treated as entertainment, not income, investment, employment, or a guaranteed way to win money.
If you want to stop using the service, you may request account closure or deletion through the account deletion tools or support contact points published by SquareKick.
28. Dispute Resolution, Arbitration, Class Waiver, and Governing Law
Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the platform, contest participation, wallet balances, payments, withdrawals, winner awards, or account activity shall be resolved through binding individual arbitration in the State of Texas before a single neutral arbitrator.
To the maximum extent permitted by law, disputes must be brought only in an individual capacity and not a plaintiff, claimant, or class member in any class, collective, consolidated, representative, or private attorney general proceeding. Jury trials and class actions are waived to the extent permitted by law.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except that mandatory consumer-protection, privacy, age, geolocation, contest, or other local laws apply where they cannot be waived by contract. For any claim that is not subject to arbitration and is not required to proceed elsewhere by non-waivable law, the parties consent to venue and personal jurisdiction in a court of competent jurisdiction located in Texas.
29. Mobile Application
SquareKick may be accessed via a mobile application. Use of the mobile application is subject to these same Terms of Service and any applicable app store requirements, device permissions, third-party platform rules, or mobile operating limitations.
30. Changes to Terms
We may update these Terms at any time. Continued use of the platform after an update constitutes acceptance of the revised Terms to the extent permitted by law.
